Agreement to terms

These Terms of Service (“Terms”) govern your access to and use of the Peptide Marketing website at peptidemarketing.com (the “Site”) and any services provided by Peptide Marketing (the “Services”). By accessing the Site or engaging the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site or the Services. Continued use of the Site after these Terms are modified constitutes acceptance of the modified Terms.

About our services

Peptide Marketing is a marketing agency that works exclusively with peptide brands and research-chemical companies. Our Services include but are not limited to: paid media management, email marketing and retention, web development, conversion-rate optimization, strategy consulting, and access to our client portal.

Specific deliverables, timelines, fees, and obligations for active client engagements are documented in separate engagement agreements (statements of work, master service agreements, or similar) signed between Peptide Marketing and the client. In the event of any conflict between these Terms and a signed engagement agreement, the signed engagement agreement governs.

Eligibility

You must be at least eighteen years old and have the legal authority to enter into binding agreements in your jurisdiction to use the Site or the Services. By using the Site or the Services, you represent and warrant that you meet these requirements.

Our Services are intended for businesses engaged in the lawful sale of peptide products, research chemicals, or related categories. We reserve the right to decline engagements at our sole discretion.

Acceptable use

You agree not to use the Site or the Services in any way that:

  • Violates any applicable law, regulation, or third-party right.
  • Attempts to gain unauthorized access to any part of the Site, our servers, or any related systems or networks.
  • Introduces viruses, malware, or any other malicious code.
  • Interferes with or disrupts the integrity or performance of the Site or the data contained therein.
  • Engages in scraping, data mining, or automated extraction of content without our express written permission.
  • Misrepresents your identity, affiliation, or qualifications.

We reserve the right to investigate and take appropriate legal action against anyone who violates this section, including removing prohibited content, suspending access, and pursuing civil or criminal remedies.

Intellectual property

The Site and all content on it — including but not limited to text, graphics, logos, icons, images, audio clips, downloads, data compilations, and software — are the property of Peptide Marketing or its licensors and are protected by intellectual property laws.

You may view, download, and print content from the Site for your personal, non-commercial use only. You may not copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the Site without our prior written consent.

All trademarks, service marks, and trade names displayed on the Site are proprietary to Peptide Marketing or their respective owners. No license to use these marks is granted by virtue of your access to the Site.

Client content and confidentiality

If you engage Peptide Marketing as a client, you grant us the limited rights necessary to perform the Services, including the right to access, use, and modify your marketing accounts, brand assets, and data as required for the engagement.

We treat all client information as confidential and use it only for the purposes of providing the Services. We do not share client identities or specific client data publicly unless authorized in writing. Case studies, performance benchmarks, and aggregated data may be referenced in our marketing materials in anonymized or aggregate form.

Third-party platforms

Our Services frequently involve managing or interacting with third-party platforms (advertising platforms, email service providers, ecommerce platforms, payment processors, and similar). These platforms have their own terms of service, policies, and enforcement actions that are outside our control.

We use commercially reasonable efforts to comply with the policies of relevant third-party platforms when managing engagements on behalf of clients. However, we cannot guarantee the actions of third parties, including account suspensions, policy changes, advertising disapprovals, or service interruptions caused by third parties.

Disclaimers

The Site and the Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Peptide Marketing does not warrant that the Site or the Services will be uninterrupted, timely, secure, or error-free, or that any errors will be corrected. We do not guarantee any specific business results from our Services. While we work diligently to deliver strong outcomes for our clients, marketing performance is influenced by many factors outside our control.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Peptide Marketing, its directors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, profits, data, use, goodwill, or other intangible losses — resulting from your use of the Site or the Services.

Our total cumulative liability arising out of or related to these Terms or the Services shall not exceed the greater of one thousand United States dollars or the total fees paid by you to Peptide Marketing in the six months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Peptide Marketing and its directors, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your violation of any applicable law, or your violation of any third-party right.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be communicated through a notice on our website or by other reasonable means. Your continued use of the Site or the Services after changes take effect constitutes acceptance of the revised Terms.

Termination

We may suspend or terminate your access to the Site or the Services at any time, with or without notice, for any reason — including but not limited to a breach of these Terms or any applicable engagement agreement.

Upon termination, the rights and licenses granted to you under these Terms cease immediately. Provisions that by their nature should survive termination (including without limitation intellectual property, disclaimers, limitations of liability, and governing law) shall survive.
